What will happen if you kill a man that was already dead?

LesK • 1 year ago

depends on the situation. if you didn't KNOW he was dead and attempted to kill him, attempted murder. if you COULDN'T know, you'd probably be charged with mutilating a corpse. if you DID know, mutilating a corpse again.

there are three basic elements to a 'crime': Means, Motive, and Opportunity.

Means, if you didn't have the ability to commit that crime, for example if you were out of the country, or the crime happened in some way that was impossible for you. if somebody was shot and you don't know how to operate a firearm or don't own/have access to a firearm. another crime with Means is running a red-light. say your car is photographed by a traffic light camera running a red-light. but, two days earlier you reported your car stolen to the police, and yes it actually was stolen. you're not claiming on the car-insurance falsely etc. since the car wasn't in your possession at the time the camera photographed it, you obviously weren't driving the car, and don't have to accept the ticket.

Motive, if you didn't have a reason to commit that crime. for example, in this case the wife knew her husband was dying within six months from cancer. she had no reason to kill him, he would be dead soon and she would get the life insurance and all of his estate. unless the husband had a will that said if he died 'somebody' else got everything and he changed the beneficiary for his life insurance. she might kill him out of anger etc. if that happened. also, i doubt the husband had enough time to divorce his wife either. six months is a short period of time to jump through all the legal hoops required. plus, the wife would contest the divorce because the husband was 'abandoning her with nothing' when he died of cancer.

Opportunity, sometimes this coincides with Means. like i said, if you were out of the country when the crime happened. or the crime happened, and you had no openings in your schedule, at work, shopping, running errands etc. an alibi is a reason/excuse that invalidates the Opportunity to commit a crime.

The true culprit is so annoying. He just kept making up stories and nobody suspected him.
